About Ava
Ava is a developing, experimental AI project. Features may change, break, or be removed. In these terms, “Ava” means the Ava app, Ava's Discord AI model, and their operator.
Experimental status
No paid plans, subscriptions, billing system, usage quotas, or commercial guarantees are currently offered.
Privacy
Depending on the features you use, Ava may receive prompts, files, generated responses, settings, your NameID code, and basic technical data needed to provide the service. Ava is designed to keep conversation data on your device when local storage is supported; if local storage is unavailable, some web data may be stored and linked to your NameID code.
Your conversations are not used to train Ava's models. Ava does not own or control the cloud hosting providers used to run its submodels, and the Ava operator and those providers may process data as needed to operate, secure, or troubleshoot the service.
Do not submit passwords, financial information, private identifiers, or other sensitive information. Data handling may change as the project develops; a fuller privacy policy will be provided later.
Discord use
If you use Ava through Discord, your messages, commands, attachments, and generated replies may be processed by Discord, Ava, and the cloud or model providers used to operate the bot. Messages sent in servers or channels may be visible to other members, moderators, or server administrators according to Discord's permissions.
Discord's Terms of Service, Privacy Policy, Community Guidelines, and applicable developer rules also apply. Server owners and administrators may set additional rules or remove the bot. Do not send sensitive or private information to Ava on Discord.
Acceptable Use
Do not use Ava to harm people, violate rights, break the law, abuse connected services, or bypass safety controls.
AI limitations
Ava may be incorrect, incomplete, outdated, biased, offensive, or unsuitable for your situation. It may misunderstand instructions, invent information, produce unsafe code, or make unexpected recommendations.
Review and test all output before using it. You are responsible for your actions, decisions, content, and use of Ava's output. Ava does not guarantee that output will be accurate, safe, available, or appropriate.
Disclaimer and liability
Ava is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee that Ava or its output will be accurate, reliable, secure, uninterrupted, or suitable for your needs.
To the fullest extent permitted by law, Ava and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or opportunities, arising from or related to Ava or its output. If liability cannot be excluded, total liability will be limited to the greater of the amount you paid for Ava in the 12 months before the event or $100. Nothing in these terms excludes liability that cannot legally be excluded or limited.
Output ownership
As between you and Ava, you retain ownership of content you provide. Subject to third-party rights and applicable law, you may use output generated for you.
AI output may not be unique, may resemble output provided to others, or may include material subject to third-party rights. Ava does not promise that output is exclusive or free of claims. You are responsible for reviewing output and ensuring that your use is lawful.
Age requirement
You must be at least 13 years old to use Ava. If you are under 18, you may use Ava only with permission and supervision from a parent or legal guardian. If the law where you live requires a higher minimum age, that higher age applies.
Model access
Ava may update, restrict, disable, blacklist, retire, or remove any model, feature, or connected service at any time. No specific model or level of access is guaranteed to remain available.
Suspension and termination
We may suspend, restrict, or terminate access to Ava if you violate these terms or the Acceptable Use rules, or if your use creates risk to people, systems, or the service. We may also discontinue Ava or any part of it at any time.
You may stop using Ava at any time.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
Updates
These terms may change as Ava develops. The last-updated date will change when this page is revised.
